U <br />Page 25 <br />(2) The development or extraction of coal (refer to the <br />Colorado Surface Coal Mining Reclamation Act 34-33-101 et seq., <br />C.R.S. 1913 as amended); _ <br />(3) Smelting, refining, cleaning, preparation, <br />transportation, and other off-site operations not conducted on <br />affected land; and <br />(4) The extraction of geothermal or ground water <br />resources. <br />1.13.2 For sites where the definitions of mineral and <br />mining operation are less clear, the Board has determined that <br />the following types of excavations are not considered mining <br />operations and do not require minerals reclamation permits: <br />(1) Extraction and use of construction materials within <br />a defined project area owned or controlled by the same person, <br />company, or agency, where the materials are not sold or hauled <br />off-site, and where reclamation of the excavation is assured by~ <br />project requirements. Examples include: <br />(a) Gravel or borrow pits or cut-and-fill <br />excavations located on government lands for local use for <br />construction, maintenance, or improvement of specific project <br />such as reservoirs, airports, public roads or highways, parks <br />and,river• channelization; and <br />(b) Agricultural excavations where no m i`aT is <br />ex orted from the site, including land leveling or aggregate <br />excavations opened for landowners' use on his own property; <br />(2) Certain excavations where materiai is exported from <br />the site but the primary intent of the project is clearly not <br />sale of construction material, and where specific local <br />government approval guarantees reclamation of excavated areas. <br />Examples include: <br />(a) Landfill sites with county or municipality <br />approva] in accordance with C.R.S. 30-20-102(1) or 30-20-105; <br />(b) Foundation excavation with a local county or <br />municipality approved building permit; <br />
