Compliance With Terms and Conditions of Previous Permit: <br />No previous permit was issued for this facility. The discharge from <br />the facility ~.ras originally reported to be percolating into the <br />ground with no connection with surface waters. A State sample sheet <br />from September, 1981, indicated that the percolation ponds did have <br />a discharge to the Los Pinos RSver. After several years of attempts <br />to eliminate the discharge,a notice of violation (NOV) and cease and <br />desist (CD) order were issued on January 26, 1990, for discharging <br />without a permit. The NOV was amended on May 29, 1990, and a <br />schedule for construction of additional facilities was added. <br />Completion of that construction in 1991 resulted in a facility which <br />is capable of meeting the required effluent limits. <br />
