As we discussed previously, the nest was discovered an May 23, 1993, by a dour operator who was <br />removing brush, in preparation for topsoil salvage, in the vicinity of the nest. On thaz daze the nest was examined <br />by mine environmental personnel and found to contain one egg. Subsequently, a buffer rune was flagged off <br />around the nest and a polity was established and communicated thaz no activity would be permitted within the <br />buffer mne until young birds have fledged and the nest is vacated. ft is critical to Trapper's mine operation how- <br />ever, that once the young have fledged, Trapper be allowed to relocate the nest and immediately resume mine <br />development activity in this area. <br />As you requested, I contaaed Lee Carlson of your Goldea, Colorado office concerning possible mitigarion mea• <br />sores rclazive to the Swainson's Hawk nest removal. He refemd me to Bob Leachman in your Grand Junction, <br />Colorado office. Mr. Leachman discussed the matter with associazes and recommended a mitigazion plan as <br />follows: <br />I. Remove the nest Gom iu current location and relocate it into a similar mountain brush site located on a nearby <br />Trapper Mine reclaimed area <br />2. Monitor the relocated nest for activity during the 1994 and 1995 nesting seasons. <br />3. Report the results of the relocated nest activity to USFWS on an annual basis. <br />Trapper agrees to this mitigation plan and by reference incorporates the plan into the Special Purpose Permit appli- <br />cation. <br />[ appreciate USFWS assistance in resolving this matter.
