MLRB, Board decision on appeal <br />Hi Mary Elizabeth and Jim, <br />This is a courtesy notice on the status of this case. <br />The MLRB decided that it will not appeal the District Court's <br />decision. <br />We have not heard whether Four States will appeal, but we intend to <br />proceed under the presumption that the company will not appeal until <br />we <br />receive notice to the contrary. <br />The Board intends to conduct two hearings, as instructed by the <br />District Court. Since this procedure is irregular, we have not worked <br />out all of the details. I expect that during the first hearing, the <br />Board will decide what issues it can consider, a schedule for witness <br />lists and exhibits lists exchanges, a time estimate for the hearing. <br />The second hearing will be held the following month, if possible, <br />during which the parties will be afforded a full and fair opportunity <br />to <br />present evidence, <br />The Division will be sending out a notice of hearing soon.
