Fish and Wildlife Service <br />?Denver, Colorado <br />Subject: Final Biological Opinion for American Soda's Yankee Gulch <br />Sodium Minerals Project <br />In accordance with section 7 of the Endangered Species Act of 1973, as <br />amended (16 U.S.C. 1531 et seq.), and the Interagency Cooperation <br />Regulations (50 CFR 402), this transmits the Fish and Wildlife <br />Service's final biological opinion for impacts to federally listed <br />endangered species for American Soda's Yankee Gulch Sodium Minerals <br />Project. Copies of this opinion should be provided to the applicant <br />because the Service has incorporated reasonable and prudent <br />alternatives and reasonable and prudent measures with terms and <br />conditions to minimize incidental take of the Colorado pikeminnow and <br />the razorback sucker, that should be included as conditions of any <br />permits issued by the Bureau of Land Management for this project. <br />Reference is made to your May 31, 1999, amendment to your April 29, <br />1999, biological assessment requesting initiation of formal <br />consultation for the subject project. The Service concurs that the <br />annual depletion of water from the Colorado River Basin "may affect" <br />the endangered Colorado pikeminnow (formerly squawiish) (pty horhP;~,c <br />i„r•;,,4) , humpback chub (I,i],a ~~) , bonytail (fyla Els~gans) , and . <br />razorback sucker (Xyravr•hen xan,c) and "may affect" their critical <br />habitat. Additionally, we concur that potential larval fish <br />entrainment "may affect" the Colorado pikeminnow and the razorback <br />sucker. Based on information presented in your original biological . <br />assessment of April 29, 1999, the Service concurs with your "no <br />effect" determinations for the southwestern willow flycatcher <br />(F.mnidonax aillii extimvs), Mexican spotted owl {S ix o ;d n a~;G <br />lucida), black-footed ferret (M,at-ela .,;a ;n 4), and whooping crane <br />(mss amp*~na), The Service also concurs with your "may affect, not <br />likely to adversely affect" determinations for the peregrine falcon <br />
