9 <br />Division of Minerals and Geology (e.g. detailed in the State's <br />Stormwater Discharge Permit and BLM's Soil Conservation, Erosion <br />and Sediment Control, Reclamation and Revegetation Plan). <br />Although consumptive water use in the upper Colorado River Basin <br />is normally treated as having an adverse effect on listed fishes, <br />in this case, American Soda is proposing to use water that has <br />undergone previous consultation review and fee assessment. <br />Attached is a recent letter from the USFWS to Unocal Corporation <br />which indicates that water associated with Unocal's existing <br />intake and pumping pipeline (up to 12,070 acre-feet) has been <br />retained in the Colorado River depletion baseline. Since American <br />Soda has apparently purchased a portion of Unocal's right to <br />this water (1,203.8 acre-feet/year, see below), it would appear <br />that American Soda's use of this water would neither represent a <br />new depletion nor be subject to a depletion fee.
