Findines with reeard to Protection of the Hydroloeic Balance <br />All of the observed hydrologic impacts are consistent with those predicted in the Probable <br />Hydrologic Consequences section of the permit application and the Division's Yampa River <br />Cumulative Hydrologic Impact Assessment. Based on the foregoing observations regarding <br />hydrologic impacts, the Division finds that P & M has minimized disturbance of the hydrologic <br />balance in the mine plan and adjacent areas, and prevented material damage outside the permit <br />area. The Division also finds that P & M has not caused hydrologic changes that adversely affect <br />the approved postmining land use in the permit area. <br />Findines with reeard to Retention of Permanent Facilities <br />Permanent facilities (gravel pad, roads, and culvert over Oak Creek) within the bond release area <br />were found to be in good repair and incompliance with bond release requirements. The Division <br />discussed the permanent retention of the Oak Creek crossing with representatives of the Routt <br />County Regional Planning Department and the U.S. Army Corps of Engineers. Neither of these <br />agencies had an objection with the proposed bond release. <br />Findines with reeard to Completion of the Reclamation Plan <br />P & M requested Phase I, II, and III (final) release for an approximate 3.3-acre area, in Sections <br />19 and 20, T4N, R85 W. The Division reviewed the bond release application, the mine permit, <br />and inspected the bond release area. Based on the review and inspection, the Division finds that P <br />& M has successfully completed all surface coal mining reclamation operations appropriate to <br />the 3.3-acrea area in accordance with the approved reclamation plan and fully met all reclamation <br />requirements of the Rules and the Act. <br />Reclamation activities that remain to be accomplished, or still require bond releases, after <br />approval of this proposed SL-09 bond release action, include: <br />Task 002. Placement of topsoil on 77.8 acres of the West Ridge area (work accomplished but no <br />bond release processed). <br />Task 003. Placement of topsoil on 150 acres of the Moffat area (work accomplished but no bond <br />release processed). <br />Task 005. Revegetate 188 acres in West Ridge area (initial seeding accomplished but no bond <br />release processed). <br />Task 006. Revegetate 15.6 acres in the Center Ridge azea (initial seeding accomplished but no <br />bond release processed). <br />Task 007. Revegetate 37.5 acres in the East Ridge azea (initial seeding accomplished but no bond <br />release processed). <br />Task 008. Revegetate 342.5 acres in the Moffat area (initial seeding accomplished but no bond <br />release processed). <br />Task 009. Revegetate 115 acres of the West Ridge diversion ditch. <br />Task 010. Reclaim the West Ridge diversion ditch. <br />Task 025. Reclaim the Moffat area collection ditch. <br />10 <br />
