The remaining reclamation of disturbed areas will be completed when this issue <br />is settled, and we again have permission to enter the property. <br />T'he Pioneer Canon Contract was structured to provide payment for performing the backfill <br />work using onsite materials designated by the Project Manager. Neither IML nor the <br />Contractor could have anticipated that the landowner (Dr. Corley), would charge a fee for <br />materials moved from one location on his property to another location on the same <br />property, and being used to perform beneficial reclamation work in accordance with his <br />previous written requests. It is a changed condition of the work, and therefor the Contractor <br />should not have to pay this fee out of his own expense. I instructed the Contractor to <br />invoice IML for the fee imposed by Dr. Corley, and executed a change order to cover it. <br />In my opinion, Dr. Corley should not have the right to charge a fee and benefit financially <br />from Federally funded reclamation work which will benefit his property.
