Sanborn Creek Addition: Township 13 South, Range 90 West, 6th PM Sec. 3: SW/4, SE/4 Sec. 4: SE/4 Sec. 9: North of Highway 133 Sec. 10: North of Railroad The Sanborn Creek Mine permit area addition contains 962 acres of land of which 793 acres are on private land owned by the Operator and 169 acres are on Federal land. The combined permit area of the Somerset Coal Mine and the new Sanborn Creek mine contains 3737 acres of land of which 1608 acres are on private land owned by the Operator and 2129 acres are on Federal land. The mine permit areas are located on the U.S. Geological Survey 7.5 minute Bowie and the U,S. Geological Survey 7.5 minute Somerset Quadrangles. Proposed Decision The Colorado Mined Land Reclamation Division proposes to approve an application for a permit revision which entails addition of a new mining area near Sanborn Creek. This new mining portion will extract coal initially from the "C" seam then ramp down to the "B" seam and continue mining there. The application was submitted by Somerset Mining Company for the Somerset Mine. This decision is based on a finding that the operations will comply with all requirements of the Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request fora formal hearing is made within thirty (301 days of the first publication of the issuance of this proposed decision, then this decision becomes final. Upon submittal of acceptable surety by the applicant, the permit revision will be effective. The permit revision application, all supporting documentation and any stipulations or conditions will become a binding part of the permit. Summary The Review Process The Somerset Mine. operated by Somerset Mining Company, is located in Delta and Gunnison Counties and is adjacent to the Town of Somerset on State Highway 133. The Sanborn Creek addition to the mine is the subject of this permit revision and the new portals will be located approximately one mile east of the town of Somerset. The permit revision will add approximately 962 acres to the permit area and increase the allowable surface disturbance by 4 acres. The original permit under the Colorado Permanent Regulatory Program was issued to U.S. Steel Mining Company, Inc. on October 11, 1983.
