My <br />observations in the basement and crawl space of the Tatum structure <br />determined that the foundation is showing relatively little sign of stress <br />and little distortion. This is unusual in my experience fora 90 year old <br />field rock and mortar foundation. Therefore, I conclude that the <br />Tatum's structure has not been exposed to mine subsidence. My <br />observations in the surrounding area corroborate this opinion by <br />suggesting that no visually detectable subsidence has occurred above <br />the mine works in closest proximity to the Tatum residence." <br />I do not believe that I have relied "on the fact and/or assurance that no <br />movement has taken place on the railroad" in arriving at my opinion. <br />(7) Mrs. Tatum is apparently laboring under the mistaken assumption that I am <br />an engineer. I am not a licensed or registered professional engineer (PE). I <br />did, however, serve as Acting City Engineer for the City of Boulder for the <br />year of 1979, in accordance with Colorado State Law at that time. I have <br />also been president (1984) of the 27,000 member Colorado Engineering <br />Council. I am, by training and experience, an Engineering Geologist, certified <br />by the American Institute of Professional Geologists (Certificate Number <br />3768), and licensed as a registered Professional Geologist in the State of <br />Wyoming (Professional Geologist Number PG-1897).
