<br />-37- <br />XX. <br />les and Underground Openings - Rules <br />Information regarding sealing of underground openings is found on pages 86-87 <br />and Figure TPS-4 of the permit application. No drill holes are proposed. <br />The applicant states that the mine entrances will be sealed in accordance with <br />approved MSHA plans and regulations. Because of the prediction that the mine <br />will not fill with water and that the portals have been constructed downdip, <br />these plans are sufficient to fulfill the requirements of Rule 4.07. <br />The proposed operation is in compliance with the requirements of this section. <br />XXI. Subsidence - Rules 2.05.6(6) and 4.20 <br />Presented on page 96 of the permit application is an inventory of structures <br />and renewable resource lands. In addition, the applicant completed a <br />subsidence survey, containing predictions of anticipated subsidence effects, <br />pages 96-98. <br />Twin Pines subsidence inventory of renewable resource lands has identified <br />only limited grazing lands and pinyon-juniper woodland within the permit and <br />adjacent area. No structures are located within the potential angle of draw <br />above the mined area. Accordingly, the applicant has projected no material <br />damage to structures or to the limited grazing/woodland areas. <br />i4ap TP-1 depicts the limits of extraction well within the leased area. There <br />will be no surface disturbance outside of the permitted area. <br />Subsidence monitoring and a subsidence control plan are, therefore, <br />unnecessary to ensure compliance. Based on the information provided in the <br />application, the Division finds the proposed operation in compliance with the <br />requirements of this section. <br />XXII. Miscellaneous Compliance - Rules 2.05.4, 4.02, 4.12, and 4.21 <br />Information pertaining to signs and markers (Rule 4.02), slides and other <br />damage (Rule 4.12), exploration (Rule 4.21) was found to be in compliance by <br />the Division. <br />Regarding the reclamation requirements of Rule 2.05.4, the permit application <br />did not adequately address reclamation of the Twin Pines No. 1 portal area. <br />Twin Pines Coal Company, Inc. succeeded to this operation on December 22, 1982 <br />and thereby committed to reclamation of this site. Therefore, the Division <br />deems it necessary to impose the following stipulation: <br />
