Because the amendment indicated GEC had disturbed 82.9 acres <br />when it was limited by its August 26, 1977 permit to 70 acres, the Board, on <br />February 28, 1979, found GEC in violation of its permit. The Board ordered GEC to again <br />revise its permit to include certain unapproved operations and to add the unpermitted 12.9 <br />acres. A 59,000.00 civil penalty was assessed, with 54,500.00 waived for certain <br />corrective actions being accomplished. <br />30. On May 23, 1979, the Board issued a Cease and Desist Order to GEC as the company had <br />as yet failed to make its January 1979 amendment submittal adequate. On June 28, <br />1979, the Board revised this Cease and Desist Order to allow for limited mining. On <br />August 21, 1979, as GEC had still not made its amendment submittal adequate, the Board <br />ordered GEC to raise its reclamation bond to 5650,000.00 by September 7, 1979 or face <br />having the original May 23, 1979 Cease and Desist Order reimposed. On September 7, <br />1979, as the increase in bond had not been submitted, the Division issued a second Cease <br />and Desist Order. <br />31. On September 13, 1979, GEC submitted First National Bank and Trust Company of <br />Oklahoma City Letter of Credit No.S4077, issued to GEC Minerals and L and G Petroleum <br />Company on September 13, 1979, in the amount of 5584,000.00. This bond, plus the <br />existing 566,440.00 bond, brought the total to 5650,440.00. <br />32. On September 26, 1979, the Board found GEC in violation of the Division's September 7, <br />1979 Cease and Desist Order for selling coal beyond that date. The Board at that time <br />also lifted the September 7, 1979 Cease and Desist Order, thereby imposing the modified <br />Cease and Desist Order of June 27, 1979. The following month, the Board issued a <br />55,600.00 civil penalty against GEC. <br />33. On November 26, 1979, the Board approved the GEC amendment (Exhibit O). On <br />March 13, 1980, GEC submitted a request to reduce its bond from $650,000.00 to <br />5380,653.66. On March 26, 1980, the Board approved a reduction to 5391,000.00. On <br />July 17, 1980, GEC submitted First National Bank and Trust of Oklahoma City Letter of <br />Credit No. 54212 in the amount of $324,560.00, replacing its previous Letter of Credit <br />No. S4077. The $324,560.00 bond, combined with the 566,440.00 bond, brought the <br />total to 5391,000.00. <br />34. On February 17, 1981, GEC submitted a new permit application under the new Colorado <br />coal mining law. This new permit application was given the number C-037-81. On <br />September 13, 1982, the application was approved and the bond amount set at <br />5550,249.00. On December 3, 1982, the permit was issued (Exhibits P1-P11), as the <br />following bonds were apparently in place at the time: <br />1 .
