<br />10.0 APJIMAS VALLEY LAND USE PLAN <br />To be used in conjunction with the Animas Valley Land Use Map <br />10.1 BASIC PLAN PROVISIONS <br />a. That any pre-existing, legal lot of record made nonconforming by this plan shall <br />be entitled to one single-family residence. <br />b. That any pre-existing dwelling unit made nonconforming in terms of density shall <br />enjoy the right of replacement unless the entire site is being redeveloped, at which <br />time the entire site shall be made to conform to the plan. <br />c. That uses made legally nonconfomaing shall enjoy the right to regulaz <br />maintenance, repair, and to some extent replacement but not expansion. <br />d. That no new subdivisions shall occur on steep slopes (30% or greater). One <br />dwelling unit is pemutted on any pre-existing, legal lot of record lying on steep <br />slopes. This provision shall in no way supersede the County's Geologic Hazards <br />Map regulations. <br />e. That all existing agricultural operations shall enjoy a right to farm and shall not be <br />subject to chazges of nuisance lodged by neazby residents. <br />f. Uses Permitted By Right need not obtain a Land Use Permit as precondition to a <br />Building Permit. Major subdivisions and Minor Exempt Subdivisions must still <br />go through the public review and approval process even while staying within <br />prescribed densities. <br />g. Operations allowed by Special Use Permit may be newly permitted or expanded if <br />the Planning Commission and the Boazd of County Commissioners determine <br />through cazeful site plan and compatibility evaluation that the proposal will not be <br />a detriment to the chazacter of the Animas Valley.
