• <br />To: <br />~1AR 2 3 2001 <br />S/~ CEMORANDUM~ <br />• <br />From <br />Subject <br />United States Department of the Interior _ <br />OFFICE OF SURFACE MINING III I II I II I II IIII III <br />RECLAMATION AND ENFORCEMENT _ 999 <br />Washington, D.C. 20240 Doc Date:12H 112001 <br />Piet deWitt, Acting Assistant Secretary <br />Land and Minerals ag~ n <br />Glenda Owens, A ting Director ~~/ <br />Office of Surface Mining <br />Recommendation for Approval, Without Special Conditions, of the Mining Plan <br />Modification for Federal Lease COC-60941 at National King Coal, LLC's King <br />Coal Mine located in La Plata County, Colorado <br />I recommend approval, without special conditions, of the King Coal Mine mining plan <br />modification based on: <br />(1) National King Coal, LLC's complete permit application package (PAP); <br />(2) compliance with the National Environmental Policy Act of 1969; <br />(3) documentation assuring compliance with applicable requirements of other Federal <br />laws, regulations, and executive orders; <br />(4) comments and recommendations or concurrence of other Federal agencies, and <br />the public; <br />(5) the findings and recommendations of the Bureau of Land Management regarding <br />the resource recovery and protection plan, the Federal lease requirements, and the <br />Mineral Leasing Act, and <br />(6) [he findings and recommendations of the Colorado Division of Minerals and <br />Geology (CO-DMG) regarding the Petmit Revision No. 7 and the Colorado State <br />program. <br />The Secretary may approve a mining plan for Federal leases undo 30 U.S.C. §§ 207(c) and <br />1273(c). Under 30 CFR Chapter V-I, Subchapter D, [find that the proposed mining plan <br />modification will be in compliance with all applicable laws and regulations. <br />• Attachment <br />
