Box 68 <br />Craig, Colorado 81626 <br />Re: Approval of Request for Transfer of Coal <br />Operators - Portion of Trapper's Permit, <br />to Empire Energy Corporation's Permit No <br />Permit and Succession of <br />Response to Stipulation No. 28 <br />C-044-81 <br />Special Note: This document to be included in Permit Documents file <br />for this operation. <br />Dear Mr. Mills: <br />On September 18, 1984, the Division approved a rider to Empire Energy <br />Corporation's mining permit to allow an extension of the permit boundary into <br />an area know as the Utah Tract and for a change in the mining technique from <br />conventional room and pillar mining to longwall mining. The increase in the <br />permit area is approximately 430 acres. The surface of this tract is owned by <br />Trapper Mining, Inc., and was contained within the Trapper Mine permit <br />boundary. Two hundred and ninety-three areas of tract have been previously <br />surface mined and reclaimed. Longwall mining may affect 201 acres of the <br />reclaimed area. Additional information is contained in the Findings Document <br />of August 10, 1984 for the Utah Tract revision. <br />As a stipulation (Stipulation No. 28) to the permit rider for the Utah Tract <br />revision, Empire Energy Corporation was required to complete the transfer of <br />permit and succession of operators process, as per Rule 2.08.6, prior to <br />longwall mining in this area. On December 10, 1984, the Division received a <br />technical package from Empire Energy Corporation containing information that <br />addresses this stipulation (this information will be inserted into <br />Appendix IV-17 of the permit document). This information was reviewed along <br />with a technical revision request from Trapper Mining, Inc. (submitted on <br />November 1, 1984) for exclusion of the tract from within the Trapper Mine <br />permit boundary. <br />The succession area is located in the El/2 of Section 5 and W1/2 of Section 4, <br />T5N, R91W of the 6th P.M., Moffat County, Colorado. The succession area is <br />shown on the Exhibit A maps submitted by Empire Energy Corporation and on Maps <br />M3, M4 and M7 of the technical revision request submitted by Trapper Mining, <br />Inc.
