15. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. <br />As of this time, NCIG Financial, Inc., the operator, is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />16. Specific approvals have been granted or aze proposed. These approvals are addressed <br />in the following section, Section B (2.07.6(2)(m)). <br />Section B -Rule 4 <br />I. Roads -Rule 4.03 <br />A. Haul Roads <br />1. The existing road into the site was to be used as a haul road. Since no coal <br />was hauled, it presently should be considered an access road. <br />B. Access Roads <br />1. The landowner has requested the retention of the access road depicted on <br />Map No. 4.2-3. Its retention is compatible with the approved post-mining <br />agricultural land use. Therefore, the Division proposes to approve <br />retention of the access road (4.03.2(1)(g)(ii)). <br />II. Support Facilities -Rule 4.04 <br />A. The only support facilities constructed during the initial phase of the mine <br />operation were a powder magazine, a water tower, and a pump house. All were <br />constructed in accordance with Rule 4.04. All were removed at the time of <br />initial reclamation. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />1. Runoff from the majority of the disturbed areas passes through a sediment <br />pond prior to leaving the permit area. The Division granted small area <br />exemptions from the use of sediment ponds. The exemptions are based on <br />the limited size of the areas and the operator's demonstration that ponds <br />and treatment facilities are not necessary for the drainage to meet the <br />effluent limitations of Rule 4.05.2 and applicable State and Federal water <br />quality standards for receiving streams. No mixing of surface drainage with <br />a discharge from underground workings will occur (4.05.2(3)(b)(i)). Small <br />Area Exemption No. 1, about 1/2 an acre, is located directly east of the <br />sediment pond. Small Area Exemption No. 2; about 4 acres, is located to <br />the west of the sediment pond, and adjacent to County Road 335. Runoff <br />through these areas is filtered prior to discharge off-site. See Map 4.7-1 of <br />Coal Ridge No. 1 Mine 12 Permit Renewal No. 3 <br />
