Lamm <br />Governor <br />July 1, 1985 _s <br />Mr. Phil Spano <br />Henderson Development Co. <br />2080 W. 60th Ave. <br />Denver, CO 80221 <br />RE: Henderson Pit - Permit No. 80-110 <br />Dear Mr. Spano: <br />Action taken by the Colorado Mined Land Reclamation Board at their <br />June 26, 1985 formal public hearing was to follow staff recommendation as <br />follows. <br />Vacate the Board issued Notice of Violation pertaining to improper <br />topsoil salvaging and stockpiling. This decision was based on our <br />follow-up inspection of the site on June 12, 1985 and your consultants <br />letter of June 19, 1985. <br />2. Reaffirm the Notice of Violation pertaining to mining the 25 foot <br />setback on the north side. <br />3. Assess no civil penalties due to point no. 1 above and due to the <br />future submittal of anew application for this area and the area to the <br />north (per your consultants' letter of June 3, 1985). The Board <br />specified no civil penalties would be assessed if the new application <br />is received within 90 days (i.e. by September 24, 1985) and <br />subsequently approved by the Board within 90 days thereafter {i.e. by <br />the December 18-19, 1985 meeting). <br />The Division would like to thank the people that attended the June 12, 1985 <br />inspection.
