'Memo to PCPC • • <br />Re: SUP 479 <br />July 16, 1990 <br />Page 2 <br />Staff conducted an on-site review of the property on July 13, 1990 and <br />observed the following: <br />• Areas to the west of the plant (Area I & II, including the railroad <br />right-of-way) have been extracted and are reclaimed with <br />revegetated banks and trees. (Exhibit 1) <br />• In Area III, the mining operation has been completed and reclamation is <br />near completion (Exhibit 1 & 2). <br />• Area IV is currently being mined with reclamation taking place as they <br />proceed. If the community growth continues at its current rate, the <br />applicant anticipates being in this area for approximately five (5) <br />more years. (Exhibit 1 & 3) <br />• Groundwater flowing into the excavation is discharged to the Arkansas <br />River under an NPDES permit (COG-500095). Water which is used for <br />wash water is first passed through settling ponds prior to discharge to <br />the Arkansas. Discharge water quality is tested monthly under the <br />NPDES permit requirements. <br />RECOMMENDATIONS <br />Staff recommends APPROVAL of Special Use Permit No. 479 with the following <br />conditions: <br />1. The applicant shall provide the Department of Planning and <br />Development with a copy of any future MLRB applications, permits, or <br />amendments within 30 days of their submittal to or approval by MLRB . <br />2. The applicant shall provide the Department of Planning and <br />Development with a copy of any further state or federal permit <br />applications (i.e. , access, NPDES, 404, etc.) and approval thereof <br />within 30 days of said application or approval. <br />3. Special Use Permit No. 479 shall be placed on a five-year review <br />(July, 1995) OR when the applicant begins removing gravel on the <br />north side of the Arkansas River.
