• CHAPTER II <br />DESCRIPTION OF THE ALTERNATIVES <br />A. Primary Alternatives Under Analysis <br />1. Alternative 1: Approval of the Proposed Mininq Plan <br />Modification with Special Federal Conditions (The <br />Proposed Action). <br />Under this alternative, the ASLMM would approve the mining <br />plan modification for Federal lease C-42481 proposed by Bear <br />Coal Company (BCC) subject to the following Federal <br />conditions: <br />1. If previously unindentified archaeological or <br />historical resources are discovered during surface coal <br />mining and reclamation operations, the operator shall <br />ensure that the resources are not disturbed and shall <br />notify Colorado Division of Minerals and Geology and <br />the Office of Surface Mining Reclamation and <br />Enforcement (OSM). The operator shall take such <br />actions as are required by Colorado Division of <br />Minerals and Geology, in coordination with OSM and the <br />State Historic Preservation Office, to properly <br />evaluate and protect the resources under the National <br />Register of Historic Places eligibility criteria (36 <br />• CFR 60.4). <br />2. Prior to beginning mining operations in the mining plan <br />modification area, the operator shall pay $188.80 to: <br />National Fish and Wildlife Foundation <br />1120 Connecticut Avenue, N.W. <br />Suite 900 <br />Washington, D.C. 20036 <br />The payment shall be accompanied by a cover letter that <br />identifies the project (i.e., Bear Mine Mining Plan <br />Modification for Federal lease C-42481) and the <br />biological opinion that requires the payment (i.e., <br />Final Biological Opinion for Bear Coal Company, Bear <br />Mine No. 3, dated May 31, 1994), the amount of the <br />payment enclosed (i.e., $188.80), the check number, the <br />names and addresses of: (1) the payor, (2) the Federal <br />agency authorizing the project (i.e., Office of Surface <br />Mining, 1999 Broadway, Suite 3400, Denver, Colorado <br />80202), and (3) the U.S. Fish and Wildlife Service <br />office issuing the biological opinion (i.e., U.S. Fish <br />and Wildlife Service, Mountain-Prairie Region--Mail <br />Stop 60120, P.0. Box 25486, Denver Federal Center, <br />Denver, Colorado 80225). <br />• <br />
