WILL REQUIRE SALT CREEK MINING TO COMPLETE AMENDED STABILITY ANALYSIS <br />AND DESIGN REVISIONS TO THE WASTE PILE PLAN. <br />The applicant has supplied a description of the geology of the permit <br />and adjacent areas in Sections 4.2 and 4.3 of volume I of the <br />application. These sections have been reviewed by the Division to <br />determine conformance with the Colorado Rules and Regulations. <br />The applicant has submitted geochemical and physical analyses of the <br />roof, floor and Coal for the Cameo seam from the McClane Canyon Mine <br />(Tables 2.1-4, 2.1-5 and 2.1-5a, Volume I, McClane Canyon permit <br />application), roof and floor analyses for the Cameo seam from the Munger <br />Canyon Mine (Tables 4.2-1A and 4.2-1B, Volume I, Munger Canyon permit <br />application) and the composite roof and floor analysis for the Upper <br />Carbonera seam from the Munger Canyon Mine (Table 4.2-1. Volume I, <br />Munger Canyon permit application). No analyses were submitted for the <br />stratum through which rock slopes will be driven between the Cameo and <br />Upper Carbonera seams. <br />The geochemical analysis of the Upper Carbonera roof and floor strata <br />(Table 4.2-1) does not contain all of the parameters required by the <br />Division. Since waste material from these rock strata will be deposited <br />in the waste rock site, an analysis of the remaining parameters must be <br />completed and submitted prior to driving the rock slopes to the Upper <br />Carbonera seam. Therefore, the following stipulation was required to <br />find the applicant in compliance with Rules 2.04.5 and 2.04.6: <br />Stipulation No. 1 <br />SIX MONTHS PRIOR TO THE DRIVING OF ROCK SLOPES WITHIN THE MUNGER CANYON <br />MINE FROM THE CAMEO COAL SEAM TO THE UPPER CARBONERA COAL SEAM, THE <br />APPLICANT MUST SUBMIT GEOCHEMICAL AND PHYSICAL ANALYSES OF THE UPPER <br />CARBONERA ROOF AND FLOOR STRATA AND ALL INTERBURDEN STRATA BETWEEN THE <br />CAMEO AND UPPER CARBONERA COAL SEAMS WHICH WILL BE ENCOUNTERED IN THE <br />ROCK SLOPES. <br />If these analyses indicate the presence of toxic or acid-forming <br />materials, the Division may require the waste pile to be covered with a <br />suitable amount of material, pursuant to Rule 4.14.3. <br />With acceptance by the applicant of the above stipulations, the <br />operation is in compliance with the requirements of this section. <br />1. The Division has approved plans for use, construction and <br />maintenance of a coal mine waste disposal area (4.10.1 (1)). <br />2. The applicant has a plan for disposal, at the approved disposal area <br />within the permit boundary, of mine waste materials generated by <br />activities outside the permit boundary. These materials include <br />coal waste generated at the McClane Canyon Mine. The applicant has <br />demonstrated that disposal of such materials will not adversely <br />affect water quality or flow, vegetation, public health, or <br />stability of the disposal area based on hydrologic, geotechnical, <br />physical, and chemical analyses. Therefore, the Division proposes <br />to approve of disposal of these materials (4.10.1(2)). <br />-35- <br />
