Mr. David Berry
Division of Minerals and Geology
Page S
package (scheduled for submittal by October 20, 2004 (TR-50). Finally, SCC completed
replacement of the W-24 series wells. The damaged wells will be abandoned in summer 2005.
YOAST
The Division noted the following items requiring attention during the September 23`~ meeting:
1. TR-25 (bond amount and slope stability [Pond 12 and Valora pit])
SCC has completed a survey of open pit length and reported the results to the Division. The
Division in return has recalculated the bond. SCC will submit the additional bond by October
13, 2004.
2. Incousistencies between the reclamation maps and actual ground conditions.
SCC believes completion of the major reclamation projects previously discussed should
rectify the inconsistencies between the reclamation maps and actual on-the-ground
conditions.
SCC has also completed work, or is in the process of completing work on several other
reclamation issues identified in past inspections. Repair of the YPM-12 drainage channel and
Armand Draw has been completed. In addition, SCC is continuing to complete construction of
postmine drainage channels as azeas are final graded (see also TR-25).
SCC believes the previous discussion addresses all of the Divisions immediate concerns. If any
items have been overlooked, SCC would appreciate feedback, and will schedule as necessary to
address them. We reiterate our commitment to completing these tasks in as timely a fashion as
possible.
If you have any questions, or wish to discuss these matters further, please do not hesitate to
contact me (970) 276-5203.
Sincerely,
gg KitcheVn G
General Manager
cc: Sandra Brown, CDMG
Chuck Burggraf, Peabody Energy
Mark Yingling, Peabody Energy
