As a <br />result of the site survey completed by MCC, the health and safety risk due to the presence of <br />the surface cracks was determined to be tninimal. MCC has reached this conclusion due to <br />the fact that the surrounding area is inherently hazardous due to heavy scrub brush, historic <br />landslide disturbances, and steep terrain. The ground cracks do not make the area any more <br />hazardous. (See also discussion of this topic in Letter from Phil Schmidt to Larry Mautz, <br />copied to CDMG, dated August 12, 1996.) Once the roads are repaired, any health and <br />safety risk will be further minimized. It is MCC's opinion that there has been no diminution <br />of any present or reasonably foreseeable future use of the property. The affected area is <br />approximately 40 acres which is approximately one percent of the total property owned by <br />the Mautz'. <br />A detailed repair plan. MCC had scheduled a contractor to begin repairing the roads on <br />August 5, 1996. However, during the meeting MCC had with Mr. and Mrs. Mautz on the <br />same day, they requested that MCC not begin repairs on their roads. MCC immediately <br />notified the contractor of the Mautz' request, and the dozer is presently on standby at the <br />Lone Pine fan, pending approval from the landowner for the contractor to proceed with the <br />repairs. The only structures that have been damaged by ground cracks, are the roads <br />surveyed during the July inspection. As stated above, it is MCC's opinion that risks to <br />health and safety are minimal and diminution of any present or reasonably foreseeable future <br />use of the affected lands has not occurred. While the contractor is in the area repairing the <br />roads on Jumbo Mountain, MCC is willing to consider repairing the roads in the area of the <br />Lone Pine cabin, as well as other ground cracks within reason. <br />5. A proposal addressing any needed changes to the permit. At this time, A1CC does not <br />believe that the approved permit requires a revision to monitoring, subsidence predictions, <br />or mitigation sections. h1CC's permit currently includes a schedule to monitor structures, <br />an adequate prediction of subsidence, and a mitigation plan if structures are damaged. <br />However, upon further evaluation, if revisions are appropriate, IviCC will submit a revision <br />to the permit. MCC is currently monitoring all adjudicated water rights on Jumbo <br />Mountain, in particular, Wilcox Reservoir and Wilcox Reservoir No. 1. <br />Please call if you have questions. <br />Sincerely, <br /> <br />Phil G.
