party in its business which results in harm to the person or property <br />of third persons, that party shall hold the other party harmless <br />therefor, and hereby indemnifies the same. <br />c. In aid of the purposes of this Section, each party shall, during <br />the term of this Agreement, carry workmen's compensation insurance <br />coverage as mandated by the State of Colorado. Certificates of insur- <br />ance demonstrating the currency of such coverage shall be provided to <br />the other party and kept current during the term hereof. During the <br />running of MI VIDA ores, access to the mill shall be restricted by <br />COM, INC. to MI VIDA's authorized representatives, COM, INC. <br />management, and COM, INC. employees properly covered under COM, <br />INC.'s workmen's compensation policies. Non-covered persons shall <br />be excluded absent the written consent of MI VIDA. <br />13. Delivery of Ore by MI VIDA <br />a. All ore which MI VIDA desires to have milled by COM, INC. <br />shall be made available for loading at the mine site or sites. COM, INC. <br />shall transport the ore to the Mill's bins on a timely basis at COM, <br />INC.'s cost. This shall be limited to pickup from loading sites located <br />within a 2-mile radius of the Mill. <br />b. Ore stockpiled by MI VIDA at its mine or sorting site(s) shall <br />be reasonably free of iron, wood, ice, snow and other debris. <br />c. COM, INC. shall complete mllling of MI VIDA ores once begun <br />and shall flush the mill circuit with a minimum of 50 tons of waste <br />rock prior to milling any other ores, subJect to MI VIDA's priority <br />milling as provided for herein. MI VIDA shall make waste rock avail- <br />able for this purpose, and shall not be separately charged for such <br />flushing. The waste rock made available may consist of dead waste or <br />very low grade dump ores, which the parties hereby agree is generally <br />adequate for flushing purposes. <br />14. Compliance With Governmental Permits. An~rovals and <br />Regulations <br />a. Each party shall bear sole responsibility for complying with all <br />governmental permits, approvals and regulations governing its <br />operations or business. <br />b.
