channels will be designed with gently sloping banks that are stabilized with vegetation and will safely pass the 10 <br />year, 24 hour event. <br />Nucla Road ~ will be reconstructed to county road standards and culverts that will pass [he pass [he appropriate <br />storm event will be placed as needed. <br />III. OBSERVATIONS AND FINDINGS <br />An on the ground inspection was performed on July 15, 1999, to verify that the conditions of the permit and bond <br />release application were met. Reclamation activities for [he bond release area took place at various times between <br />1996 through 1998. The parcel of land requested for release is south of B-Road, in Section 6, and in the present <br />active mining-reclamation area of New Horizon Mine. The legal description of this parcel is as follows: <br />A tract of land in Montrose County, Colorado, beginning at a point which is the <br />SE comer of Section 6, T46N, R 15 W, bearing N 49"~ 15' OS" W, a distance of 3836.09', and <br />Thence I013.6T on a bearing of N 06C 46' 27" E <br />Thence 658.18' on a bearing of N 85 C 4T 40" W <br />Thence 376.35' on a bearing of N 18^ 00' 20" W <br />Thence 336.80' on a bearing of N 590 29' S2" E <br />Thence 747.88' on a bearing of N 09C 35' 09" E <br />Thence 417.95' on a bearing ofN 45C 14' S3" E <br />Thence 337.37 on a bearing of N 88'C 53' 36" E <br />Thence 1910.83' Due South <br />Thence 376.46' on a bearing of S 16G 55' 45" E <br />Thence 147.33' on a bearing of S 44C 33' 43" E <br />Thence 230.12' on a bearing of S 09^ 3T 09" W back to the beginning <br />for an area of 43.4 acres MOL. <br />The postmining configuration of [his area closely resembles the original contour and drainage patterns. The <br />reconstructed Nucla Road 5 meets the county rules and is far superior to the original Road 5. <br />The drainages had broad and relatively mild slopes and were well vegetated. All water from the disturbed area is <br />routed [o Pond 7 which is the only sediment control pond for the Mine 2 area. All of the permanently reclaimed <br />drainages in the area blend into the site's original topography and aid in the approved post mining land use of <br />dryland and irrigated pastures. The reclaimed topography, channel gradients and general engineered designs are <br />in compliance with all rules and regulations. <br />Backfilling and grading for the bond release area was closely inspected. No signs of differential settling at [he face <br />of the highwall/pit interface, subsidence, or erosion were noticed. The site was heavily vegetated and showed no <br />signs of any water ponding or standing. All backfilling and grading requirements of [he bond release area are in <br />compliance with all of [he Rules and permit requirements. <br />Summary and Conclusions <br />Based upon a review of the mine permit, [he applicant's bond release application. and site inspections, the Division <br />finds that Western Fuels-Colorado has completed backfilling, grading and drainage reestablishment at the New <br />Horizon Mine in accordance with the approved reclamation plan. <br />
