Shelton <br />Director <br />T0: Sandy Emrich <br />FROM: Dave Craig <br />RE: Fish Creek AVF Findings for the Seneca Mine <br />FINDINGS OF COMPLIANCE AND PROPOSED STIPULATIONS <br />The Division has determined that Fish Creek, in the vicinity of the <br />Seneca Mine, is an alluvial valley floor (AVF). Information submit- <br />ted by the applicant indicates that: (1) Deposits of unconsolidated <br />stream-laid materials were identified along Fish Creek (2) Suf- <br />ficient water and irrigable land is availa-le to support flood irriga- <br />tion activities; and, (3) A shallow alluvial water table and vegeta- <br />tive species indicate the presence of subirrigation. Exhibit 7-16 <br />of the applicant's AVF study delineates the extent of the alluvial <br />valley floor along Fish Creek. <br />Fish Creek Find <br />The proposed surface coal mining operations would not interrupt, <br />discontinue, or preclude farming on the identified alluvial valley <br />floor. (Rule 2.06.8(5)(a)(i)). <br />None of the proposed mining operations would be located within the <br />alluvial valley floor. Therefore, direct impacts resulting from <br />the physical disruption of alluvial or channel materials will not <br />be realized. Farming activities are not currently practiced in <br />Fish Creek in the vicinity of the Seneca Mine. Therefore, farming <br />will not be interrupted or discontinued. However, there is a <br />slight possibility that farming may be precluded on the AVF. The <br />applicant has identified a potential secondary impact which could <br />affect future water quality within the AVF. This is due to the <br />leaching of dissolved salts from the spoil material generated at <br />the mine. This impact is further discussed below and is not con- <br />sidered significant enough to warrant changes in the mine and <br />reclamation plan. <br />2. The proposed operations would not materially damage the quantity <br />or quality of water in surface and underground water systems that <br />supply those alluvial valley floors or portions of alluvial <br />valley floors.
