material can be used as fill elsewhere in the storage yard area below the road. A slight <br />modification directly north of the road is necessary due to permanent retention of the road <br />back into Ciruela and Apache canyons. <br />Map 3, Final reclamation of the site, indicated only two areas of topsoil re-application, the <br />development waste pile and the tipple/loadout area. The Division would like more details <br />with regard to the additional areas that require reclamation and the topsoil resources <br />available. For your information, the Division has identified the following topsoil resources <br />at the site. <br />TS Pile Location Volume (cvl Comments <br />TS1 Ciruela 2216 A horizon <br />TS2 Ciruela 5333 B&C horizon <br />TS4 Pond 5 3475 for pond 5? <br />TSS east road 225 for substation? <br />road-3rd N next to road 256 O&G transfer? <br />at 3rd N fan site 431 O&G transfer? <br />NW #1 fan site 82 O&G transfer? <br />Bioremed. above yard 980 usage? <br />What are the specific plans, if presently known, for each of the above-listed topsoil piles? <br />As I understand it, the south rail spur will be removed. Railroad ties and rail will be <br />removed to the extent possible. The Division has no problem with burial of remaining or <br />broken ties along this spur, assuming they are buried by 2-4 feet of material. <br />Upon return to the office, I checked Division files with regard to approval of concrete <br />disposal at the Golden Eagle portal slope area. We did receive a cover letter and cross- <br />sections concerning concrete disposal at two locations at New Elk and the portal area at <br />Golden Eagle. However, on July 24, 1996 I spoke to Bill Harbrecht about my review of this <br />information. One of the numerous items I discussed with Bill was that the Division did not <br />receive a formal application form for these revisions and also, that we needed individual <br />applications for each site, as they are separate permits and need to be handled separately. <br />He indicated at that time that the plans had changed, as Addington was prepared to succeed <br />the New Elk permit, therefore no reclamation would be occurring any time soon at New <br />Elk. The Division did not receive any additional revision requests or information that time, <br />therefore, concrete disposal at the Golden Eagle mine is not approved at this time. <br />I also checked the Division files for the engineering report for a proposed change in <br />outslope at the Golden Eagle development waste pile. We have no record of receipt of this <br />report, as a stand alone submittal or as a revision. If a proposed change in the outslope is <br />desired, then you will need to submit this report and the appropriate permit pages as a <br />technical revision to the permit. <br />
