few outbuildings or corrals with no consequences to public health and safety. <br />V. SUMMARY <br />The New Pryor site is abond-revoked site. Reclamation was completed under a <br />Cooperative Agreement with the Office of Surface Mining and Enforcement. The <br />reclamation work was completed under this agreement and closeout ofthe agreement <br />is documented in a July 9, 1992 letter from the Division to the Office of Surface <br />Mining. No bond money remains for any additional work at this site. The prospects <br />of ever collecting any additional bond money through the liquidation of Union <br />Indemnity via the State of New York Insurance Division appears unlikely, given the <br />passage of twenty yeazs since Union Indemnity filed for protection under Chapter 7. <br />No public comments were received concerning the TOJ process from the public or <br />from the landowners. The landowners did not attend the final inspection and have <br />voiced no objections during the revegetation liability period. Periodic Division field <br />inspection has identified no significant on-the-ground issues and final inspection <br />indicated the site is in excellent condition. The post-mining land use of rangeland <br />has been achieved, with a self-sustaining mix of grasses and forbs well established as <br />demonstrated by results of two years of vegetation sampling. Actual use of the <br />reclaimed area for cattle grazing has been demonstrated and observed during the later <br />years of the revegetation period. The site presents no hazards to public health and <br />safety. <br />VI. PROPOSED DECISION <br />The Division finds that all surface coal mining reclamation operations have been <br />completed in accordance with the approved reclamation plan and met all reclamation <br />requirements of the Rules and the Act, to the extent possible considering the revoked <br />nature of the permit. The site appears to have successfully achieved the post mining <br />land use. Based on the findings set forth above, the Division proposes to terminate <br />jurisdiction at the New Pryor Mine. This proposed decision terminates all Division <br />of Minerals and Geology involvement for the permit area of the New Pryor Mine. <br />Any person with a valid legal interest, which might be adversely affected by this <br />proposed decision, may request a formal public hearing before the Mined Land <br />Reclamation Board in accordance with Section 3.03.2(6). Public notice of this <br />proposed decision will be published twice in the Huerfano World for two weeks as <br />soon as possible. Requests for public hearing must be submitted to the Division in <br />writing within thirty days of the first publication in the Huerfano World. If no <br />hearing is requested within thirty days, the Division's decision will become final. <br />VII.
