Introduction This document is the decision package prepazed by the Colorado Division of Minerals and Geology (the Division) for the Hamilton Mine. This document includes: 1) the proposed decision to approve the permit renewal 02; 2) a summary which includes a history of the review of the permit application, a description of the environment affected by the operation, and a description of the mining and reclamation plan; and 3) the written findings of compliance the Division has made as required by the Colorado Surface Coal Mining Reclamation Act. Detailed information concerning the findings of compliance can be found in the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining. The Division received an application for a pemut renewal to conduct surface coal mining and reclamation operations at the Hamilton Mine an June 14, 2001 from J. E. Stover and Associates representing Honeywood Coal Company. The mine is located on private lands within Montrose County, Colorado. The legal description of the lands included within the pemut area is: T46N, R15W, Section 32-E%z, E%z and Section 33 W%z, S%zNW%<NE'/<, SEYNE'/4, W~/zNW'/<SE'/<, N.M.P.M.; T45N, R15W, Section 4-Portions of Lots 3, 4, 5, 6, 11, & 12 Section 5-N'/zNE'/<NE'/<, N.M.P.M. Containing 757 acres more or less. Technical Revision 8, submitted in August 1999, reduced the permitted acreage by 440 acres. Proposed Decision The Colorado Division of Minerals and Geology proposes to approve an application to renew a permit to conduct coal mining reclamation operations. This decision is based on a Bending that the operations will comply with all requirements of the Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30) days of the fast publication of the issuance of this proposed decision, then this decision becomes final. Upon submittal of acceptable surety by the applicant, the pemrit will be issued. The permit application, ail supporting documentation and any stipulations or conditions will become a binding part of the permit. All previous conditions and stipulations have been complied with.
