<br />Section I - History <br />(continued) <br /> <br />The Division issued a decision on August 10, 1989 to approve the transfer of <br />mining permit C-81-038 from Colorado Westmoreland Inc. to Cyprus Orchard <br />Valley Coal Corporation. <br />Mining and reclamation activities are proceeding according to the plan. This <br />mine remains in active status and is focusing on reopening the original mine <br />portals that were closed by the 1986 fire. <br />Since permit renewal, five Notices of Violation (NOV) have been issued. One <br />NOV was issued June 6, 1989 for failure to submit designs for diversion <br />ditches (NOV C-88-018). The NOV was upheld and $350.00 in civil penalties <br />were paid. <br />NOV C-90-008 was issued on February 16, 1990 for failure to repair the west <br />portal cut failure in accordance with approved Minor Revision No. 62. The <br />violation was upheld and $800.00 in civil penalties were paid. <br />On October 18, 1990, two NOV's were issued (C-90-047 and C-90-048). One was <br />issued for failure to maintain haul road culverts to have adequate drainage, <br />and the other was issued for failure to protect stockpiled and redistributed <br />topsoil from wind and water erosion. Both were upheld and $850.00 in civil <br />penalties were paid. <br />The latest NOV (C-91-004) was issued May 15, 1991 for failure to stabilize <br />soil materials from wind and water erosion. This violation was also upheld <br />and $500.00 in civil penalties were paid. <br />There are no outstanding or pending violations as of January 24, 1992. <br />-3- <br />
