Section III - Status of Stipulations
(continued)
Stipulation No. 16
Colorado Westmoreland, Inc. is directed to finalize the design of the
proposed coal processing waste structure at the Orchard Valley Mine.
This design is to be completed by June 30, 1982. Prior to appropriate
amendment of the mine plan, the operator may continue placement of coal
processing waste at the existing waste pile location. However, waste
placement must conform with the requirements of Rule 4.10.4(3), and the
total amount of coal processing waste placed in the existing site shall
not exceed 25,000 yards, including waste now deposited at that site. In
the event that the total quantity of waste disposed of at the existing
site exceeds 20,000 yard3, the operator shall inform the Division
immediately. If total waste placement is anticipated to exceed
25,000 yard3 at the existing site, the operator shall complete a
stability analysis of the existing coal processing regulations of
Rule 4.10. If the total quantity of coal processing waste exceeds
25,000 yard3 at the existing disposal site, that structure shall be
brought into conformance with the performance standards of Rule 4.10
within six months thereafter. Furthermore, in addition to the inspection
and reporting or calculations to verify the total accumulated quantity of
coal processing waste disposed of at the existing site as a portion of its
quarterly inspection report to be submitted to the Division.
Resolved: Waste structure design submittals were received by the Division
in 1982, 1983 and 1984. They are currently incorporated into the permit
application in Volume 6A.
Stipulation No. 17
Colorado Westmoreland, Inc. must submit to the Division a complete topsoil
salvage plan for the proposed six-acre expansion of the waste disposal
area within one month after the location of this file has been determined,
and prior to any disturbance to the area. This plan must include
site-specific soil profile descriptions, sampling of soil horizons in
sufficient detail to determine salvage depths, soils analysis for
representative samples of each major soil horizon for each soil type for
the soil testing parameters listed in Appendix B, a Soils Suitability
Table, and a table showing stripping depths and salvage volumes. This
plan need only consider those portions of the six-acre area which will be
disturbed during the term of the permit.
Resolved: A topsoil handling plan for the waste structure was reviewed
June 15, 1983 by the Division. Topsoil handling at the waste pile and
throughout the site is described in Section 2.05.3(5) in the permit
application.
Stipulation No. 18
Following stockpiling, topsoil stockpiles that will not be redistributed
for five or more years shall be seeded with the proposed permanent seed
mix (excluding shrubs and trees) and not the temporary seed mix.
Resolved: CWI made a commitment to use the permanent seed mix on long
term topsoil storage piles in Section 2.05.4(2)(e>(ii) of the permit
document.
-10-
