One, we believe that the tee fence posts which <br />were painted orange and placed by Harrison Western to mark their <br />boundary are incorrectly and inaccurately placed. Two, we believe that <br />the topsoil you said was used for the diversion ditch berm has been <br />permanently lost. Three, we believe that the Notice of Violation <br />C-92-017 was not abated by Sept. 14, 1992. <br />In the preparation of a topology map of the Westpit area to propose a <br />better diversion ditch, it was readily apparent that there is a very <br />large deviation of the Harrison Western boundary markers from the area <br />depicted in the compliance agreement dated Apr. 22, 1992., which is the <br />only reference we have been able to receive from you. We have enclosed <br />a map of approximately the same scale as the compliance agreement map <br />showing the three boundary areas: the original legal description, the <br />compliance agreement area, and the Harrison Western boundary posts. <br />The topsoil was removed from <br />the diversion ditch instead <br />Aug. 11 and 17, 1992, storms <br />topsoil. <br />approximately 5,000 sq, ft. to construct <br />of stock piling that topsoil.
