Criteria and Schedule for Release of Performance Bonds (Rule 3.03.1) <br />(continued) <br />Drainage control has been accomplished in compliance with the approved plan. <br />The sediment containment ditch appears stable and well maintained. The <br />sedimentation pond appears to be operating as designed. Small contour furrows <br />have been constructed across the steeper sections of reclaimed slopes to slow <br />runoff and reduce erosion. Mulch has been applied and anchored with netting for <br />all Small Area Exemptions as required by the approved plan. Topsoil has been <br />applied to the reclaimed slopes of the pit area to a depth of 11 to 13 inches. <br />Vegetative cover of the reclaimed slopes had not yet been established at the <br />time of the bond release inspection. <br />All buildings and structures (except for the oil tank containment area) approved <br />to be removed have been reclaimed in accordance with the approved plan. The <br />road that passes through the permit area has been approved to remain. The <br />sedimentation pond has been approved to remain to provide water for livestock <br />use. The concrete foundation located immediately south of the oil tank <br />containment area has been approved to remain for use by the current landowner. <br />The only remaining reclamation work requiring earthwork is: <br />Regrading of the oil tank containment area after appropriate disposal of <br />any contaminated soils; <br />Backfilling of the small pre-law subsidence feature as per <br />Section 2.05.6(6) of the permit; and <br />Removal and reclamation of the sediment containment ditch. <br />Proposed Decision <br />The Division finds, based on the findings in this document,that the <br />Rimrock Strip Mine is eligible for a 507. release of bond for successful completion of <br />backfilling, regrading and drainage control. Specifically excluded from the release <br />are the oil tank containment area, the remaining subsidence feature and the sediment <br />containment ditch. <br />Rule 3.03.1(3)<d) requires the Division to retain at a minimum, sufficient bond to <br />complete the approved reclamation plan. The Division has reviewed the bond <br />calculations computed in July 1992 and finds that sufficient bond is held by the <br />Division to allow fora 50°e release, but not for the requested 607. release. Of the <br />original $62,000.00 bond, the Division proposes to release $31,000.00, and believes <br />the remaining $31,000 sufficient to complete all remaining reclamation on site. <br />WHE/ern <br />9465E <br />
