r- ~ <br />• • <br />- 2 - <br />Summary of the Review Process <br />Landmark Reclamation, Inc., the operator for Rimrock Coal Company, applied for a <br />partial bond release under the Colorado Surface Coal Mining and Reclamation Act for <br />backfilling, regrading and drainage control work completed in accordance with the <br />approved reclamation plan for the Rimrock Strip Mine. The mine is located <br />approximately three miles east of Trinidad, Colorado, on County Road 73.4, near the <br />abandoned town site of Engleville in Section 29, Township 33 South, Range 63 West of <br />the 6th Principal Meridian. The mine site is located on the U.S. Geological Survey <br />7.5 minute quadrangle map titled "Trinidad East". Landmark Reclamation, Inc., the <br />operator, requested that 60X of the reclamation bond for the mine be released <br />($37,200.00 of the current $62,000.00 bond). <br />An application for Phase I bond release was received by the Division on <br />May 26, 1993. The application was deemed complete, following receipt of the proof of <br />publication of public notice, on November 2, 1993. The Division scheduled and <br />conducted a bond release inspection on November 12, 1993. <br />The site inspection was conducted in accordance with Rule 3.03.2(2). Representatives <br />of the Division and Landmark Reclamation, Inc., were present. Upon review of the <br />notice procedures, outlined in Rule 3.03.2(2), the Division determined that the <br />landowner, Mrs. Gloria Davis, had not been initially informed of the inspection. On <br />November ]B, 1993, the Division provided the appropriate notice to Mrs. Davis and <br />rescheduled another inspection for December 1, 1993. On November 23, 1993, the <br />Division received a statement from Mrs. Davis in which she waived her right to <br />participate in the bond release inspection. <br />On December 1, 1993, a representative from the OSM conducted a follow-up inspection <br />at the Rimrock Strip Mine regarding the Phase I bond release and found no problems <br />with the mine site at that time. Representatives from the Division were present at <br />the December 1, 1993 OSM inspection. <br />
