In actual observation of <br />the ditches, they have been stable for the past five years. Further, <br />4.03.3(3) provides that field-design methods may be used for light-use <br />roads. We do not believe that additional structures are required for <br />the road ditches. <br />10.a. The submitted map does show the permit boundary where the area of <br />the map covers the boundary. 2.10.1(3) does not require a label. <br />b. The lower pond is excavated with a raised area on its north side. <br />The contour map shows that the dam and north side shall be cut to <br />provide fill in addition to the temporary stockpile of sediment. <br />Approximately 600 stere will be needed to fill the lower pond. The <br />middle pond is constructed on a hillside with predominantly a dam for <br />water retention. That pond will require approximately 600 stere of <br />material to be moved, with the dam, the perimeter ditch bank and the <br />south pond bank as the material source as shown on the contour map. <br />Please compare the submitted proposed contour map to the existing <br />contour map as we requested in our response. With regard to the middle <br />pond, note that the perimeter ditch banks have been cut in the 6220 <br />through 6240 contours (the various contours are indicated by numbers <br />such as 6220, and all points on that contour line are at that <br />elevation). Then note that the contour lines north and south of the <br />pond are wider apart indicating less slope than the existing topography. <br />To pick one contour line, i.e. the 6250 line, please see that there will <br />be approximately a 6 ft. cut in the area south of the pond. The low <br />spot of the pond will require 6.4 ft. fill. <br />We would refer you to a previous map no. 2.05.4C, 4.OSC, vol. 3, section <br />2.05.4, showing very similar post pond reclamation contours. This map <br />should have sufficed instead of having to provide a new one, verifying <br />our position that we have not changed anything with the proposed contour <br />map. <br />You have not answered our question about the lateness of this mid-term <br />review in violation of 2.08.3. <br />Sincerely, <br />W <br />W.D.
