-60- <br />XXIII. MISCELLANEOUS COMPLIANCE (2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.28, 4.30 <br />The following categories are applicable to this section: <br />Surface Mining Near Underground Mining <br />Signs and Markers <br />General Requirements <br />Slides and Other Damage <br />Protection of Underground Mining <br />Coal Processing Plants and Support Facilities Not Located At <br />or Near the Mine Site or Not Within the Permit Area for the <br />Mine <br />Cessation of Operations <br />The application was reviewed to determine compliance with the above categories <br />and applicable regulations. The Division finds the application in compliance <br />with the requirements of this section. <br />XXIV. OPERATIONS ON LANDS SUBJECT TO LIMITATIONS OR PROHIBITIONS - RULES <br />~~ <br />The Division reviewed the application with respect to Rule 2.03.7 and <br />2.07.6(2). The Division finds that the operation is not included within an <br />area designated unsuitable for surface coal mining operations in an <br />administrative proceeding begun under Rule 7 or 30 CFR 769 of the Federal <br />Regulations. <br />The operation is in compliance with the requirements of this section. <br />XXV . <br />Based on the information supplied in the application, the Division finds, in <br />accordance with Rule 2.07.6(2)(b), that the proposed mining and reclamation <br />activities can be feasibly accomplished. <br />The application is in compliance with the requirements of this section. <br />XXYI. COMPATIBILITY WITH ANTICIPATED ADJACENT OPERATIONS (2.01.6 (2)(i) <br />Orchard Valley mine's proposed operation is consistent with operations <br />anticipated to be performed in ad3acent areas. <br />The proposed operation is in compliance. <br />XXVII. RECLAMATION FEES REQUIRED BY 30 C.F.R. CHAPTER YII. SUBCHAPTER R - RULE <br />The Division, using the pplicant Violator System supplied by the Office of <br />Surface Mining, U. S. Dep rtment of the Interior, finds that as of <br />March 31, 1988, Colorado Westmoreland Inc. is current with their payment of <br />reclamation fees require, by 30 C.F.R. Chapter VII, Subchapter R. The <br />operation is in compliance with the requirements of this section. <br />1489E <br />
