-12- <br />The preanining land use classifications on the area are: 1) grazing land for <br />domestic livestock and wildlife; 2) orchard land in the area of the loadout <br />facilities; and 3) previous mine disturbances. <br />After mining, Colorado Westmoreland Inc. plans to return the land to the <br />pre~nining land uses of grazing for livestock and wildlife for the mine site <br />and orchard land for the loadout facilities. The permit renewal will not <br />change the previously approved post~nining land uses. <br />The Division hereby approves the postanining land uses of the proposed <br />operation, It was determined that grazing for both livestock and wildlife for <br />the bench areas and orchard use for the storage silos, truck dump, train <br />loadout areas, and the railroad spur meets the requirements of Rule 4.16 and <br />2.01.6 (2 ) (1 ). <br />The proposed operation is in compliance with the requirements of this section. <br />III. CULTURAL AND HISTORIC RESOURCES (2.04.4, 2.05.6(4)) <br />Cultural, historic and archaeological resource surveys were conducted over the <br />proposed life of mine and adjacent areas. The methodology and results of <br />these surveys are set forth in detail in the Archaeological Appendix in Volume <br />9B. The State Historical Preservation Officer reviewed the 1983 <br />application/permit revision and the 1986 permit revision and has determined <br />that there are no sites within the permit area currently listed in the <br />National Register of Historic Places. Subsequently, and in accordance with <br />2.07.6 (2 )(e ), the Division finds that the proposed mining operation will not <br />adversely affect and publicly owned park or place listed on the National <br />Register of Historic Places. <br />Additionally, although not required by Colorado regulations, within the <br />Federal Regulations, there is a further consideration of "cultural and <br />historic resources eligible for listing on the National Register of Historic <br />Places:. SurvQys classified seven of these sites as eligible for the National <br />Register, pending further investigation. None of the seven are going to be <br />disturbed by development activities, and none will be undermined. The Roatcap <br />Game Trail Site (5DT 271) was excavated in late 1986 to ensure that increased <br />access in the East Roatcap drainage would not result in vandalism. Several of <br />the other sites have a very limited potential for subsidence damage, as they <br />are found on the margins of the angle of draw. <br />The Division finds the operation in compliance with the requirements of this <br />section. <br />IV. GEOLOGY (2.04.5 and 2.04.6(2)) <br />Information on local and regional geology can be found on pages 15 to 26 of <br />Section 2.04.6, of Volume 1. Maps 2-1, 2-2, 2-7, 2-8, 2-11, 2-12 and 6A-8 <br />identify pertinent geologic features. Waste rock geochemical analyses can be <br />found in Yolume 6A.
