T <br />{ <br />PROPOSED DECISION <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit to conduct surface coal mining <br />operations at the Coal Gulch Mine. This mine is located on private and state <br />lands within La Plata County, Colorado. The legal description of the lands <br />for the permit area is: <br />- portions of the NW 1/4 NW 1/4 and N 1/2 SW 1/4 NW 1/4 Sec. 22, <br />- portions of the N 1/2 NW 1/4 and NE 1/4 Sec. 21, <br />- and portions of Sec. 16, <br />- all within T35N, RI OW of the New Mexico Principal Meridian. <br />This decision is based on a finding that the existing and proposed operations <br />will comply with all requirements of the Colorado State Program as found in <br />the Colorado Surface Coal Mining Reclamation Act, C.R.S, as amended, <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no requests for a formal hearing are made within 30 days of the issuance of <br />this proposed decision, then this decision becomes final, and upon submittal <br />of acceptable surety by the applicant, the permit will issue and the permit <br />application and stipulations contained herein will become a binding part of <br />the permit. <br />
