Stipulation No. 18 <br />WITHIN THIRTY (30) DAYS OF PERMIT ISSUANCE, THE APPLICANT MUST SUBMIT TO <br />THE DIVISION FOR APPROVAL A DETAILED PLAN FOR MONITORING THE SEDIMENT <br />POND pH AND TREATING THIS WATER IF NECESSARY. THE TREATMENT PLAN SHOULD <br />INCLUDE THE TYPE AND AMOUNT OF REGEANT TO BE UTILIZED, METHOD OF <br />APPLICATION, AND WHEN AND HOW THE PLAN WILL BE IMPLEMENTED. <br />The applicant has requested a small area exemption for approximately 1.7 acres <br />southwest of the sediment pond. Runoff from this area will be directed to a <br />small catchment basin below the sediment pond outlet. The area of the small <br />area exemption is to be used for a general use area and coal storage. If this <br />area wi71 be actively used for coal storage there is a potential for the coal <br />fines to contribute suspended solids to the downstream system. The Division <br />will grant this exemption from sediment control only if the applicant commits <br />to one of the following: <br />1. No coal storage in this area. <br />2. Demonstrating the small area exemption does not allow contribution <br />of additional suspended solids based upon monitoring data from the <br />catchment basin outlet. <br />Stipulation No. 19 <br />PRIOR TO THE DIVISION APPROVING THE SMALL AREA EXEMPTION, THE APPLICANT <br />MUST COMMIT TO NO COAL STORAGE IN THIS AREA OR DEMONSTRATE THAT IN <br />GRANTING THIS SMALL AREA EXEMPTION THERE WILL BE NO INCREASE IN <br />SUSPENDED SOLIDS OUTSIDE THE PERMIT AREA. <br />With the acceptance of the above stipulations, this section is in compliance <br />with the applicable regulations. <br />XX. Bonding - Rule 2.05.4(2)(b) <br />The reclamation cost sections of the permit application are found in <br />Section 3.00 of Volume I, and Exhibit 5 of Volume II. <br />The bond amount is based upon "worst case" conditions occurring when the mine <br />is in full production. The total cost for reclaiming the operation has been <br />calculated by Peerless Resources and the Division to be $140,000.00. <br />With the posting of the bond for the Coal Gulch Mine as calculated by the <br />Division, the proposed operation will be in compliance with the requirements <br />of this section. <br />
