• <br />AGREEMENT <br />R~uldcr County, through its special use process, has rectuested a <br />25 foot wide easement along the south side of the St. Vrain Creek <br />team lcestcrn Paving Construction Company, for a trail. This <br />:•,::;~•n:~•nt will become available when public access is provided on <br />property to the east and west of the subject property. At this <br />time, a suitable legal description will be developed. This <br />agreement stipulates that the Parks and Open Space Department <br />will fence the easement if the trail is to be utilized k:y the <br />public while Western Paving is mining their property. <br />If Western Paving has completed the mining of their proF>erty, <br />the Parks and Open Space Department may utilize the trail ease- <br />m~nt and fencing will only be a requirement if the Park:: and <br />Open Space Department determines that it is necessary ii` tres- <br />passing becomes a problem. If Western Paving should se].1 the <br />property, the easement will still belong to Boulder Cour:ty. <br />The County agrees to provide adequate patrolling and maintenance <br />' of the easement when said easement is available for public access <br />across the property. <br />In consideration of issuance of said Special Use Permit, the <br />undersigned agree to the above. <br />t•;est~rn Paving Construction Company The Board of Country Commissioners <br />By: <br />George R.
