<br />CYCC is requesting Phase II bond release on 2884.5 acres and Phase III bond release on 224.4 acres. <br />Reclamation liability release requested for the Phase II release is $4,114,977.00. The Phase III <br />reclamation liability release requested on Area 41 is $45,640.00. <br />No written objections, or requests for an informal conference regarding the bond release application were <br />received by the Division. <br />The Division scheduled and conducted a bond release inspection on July 19, 2000. The site inspection <br />was conducted in accordance with Rule 3.03.2(2). Persons in attendance at the July 19, 2000 inspection <br />included Janet Binns of the Division, Mr. Rick Mills of CYCC (permitee and surface landowner), Mr. <br />Henry Austin of the Office of Surface Mining, Denver Field Division, and Mr. Robert Emst of the Craig <br />district office of the Bureau of Land Management. <br />CRITERIA AND SCHEDULE FOR BOND RELEASE <br />PHASEI <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when <br />the permittee successfully completes backfilling, regrading, and drainage control in accordance <br />with the approved reclamation plan." The approved post-mining topography for the Eckman Park <br />Mine and Energy Mine No. 1 was released (SLOS) after meeting Phase I bond release <br />requirements. Permanent access roads have been approved and have been found to support the <br />post-mining land-use of pastureland. <br />PHASE II <br />Rule 3.03.1(2)(6) states, "Up to eighty-five percent of the applicable bond amount shall be <br />released upon the establishment of vegetation which supports the approved post-mining land use <br />and which meets the approved success standard for cover... based on statistically valid data <br />collected during a single year of the liability period". In regard to Phase [I bond release, Rule <br />3.03.2(3)(6) also states, "No more than sixty (60) percent of the bond shall be released so long as <br />the lands to which the release would be applicable are contributing suspended solids to streamflow <br />or runoff outside the permit area in excess ofpre-mining levels as determined by baseline data or <br />in excess of levels determined on adjacent non-mined azeas". <br />Mining in the Eckman Pazk Mine and Energy Mine No. 1 azea began in the late 1970's. Perrnit <br />maps 41 (dated 4(16(80) and 42 (dated 4(16(80) document portions of Eckman Pazk Mine and <br />Energy Mine No. lazea that were mined prior to August 3, 1977, between August 1977 and May <br />1978, between May 1978 and August 1979, and some portions mined after September 1, 1979. <br />Mined areas were reclaimed and seeded between 1977 and 1992. <br />Colorado Yampa Coal Company: SL07 Findings I I/00 page 4 c:\jhb\C081071\SL07tnd.doc <br />
