<br />Introduction <br />This document is the proposed decision of the Colorado Division of Minerals and Geology ([he Division) <br />in response to a request for a partial Phase II and a partial Phase III bond release at the Eckman Pazk Mine <br />and Energy Mine No. 1, Division permit number C-81-071. The package contains four parts. These <br />include: 1) procedures and summary of the bond release process; 2) criteria and schedule for bond release; <br />3) observations and findings of the Division regarding compliance with the bond release requirements of <br />the Colorado Surface Coat Mining and Reclamation Act and regulations promulgated thereunder; and 4) <br />the Division's proposed decision on the request for bond release. <br />Detailed information about the review process can be found in the Act and the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. All Rules referenced within this document <br />are contained within the Regulations. Detailed information about the mining and reclamation operations <br />can be found in the permit application on file at the Division offices, located at 1313 Sherman Street, <br />Room 215, in Denver, Colorado. <br />The Eckman Park Mine and Energy Mine No. 1 were contiguous surface mines which were permitted and <br />operated by Colorado Yampa Coal Company (CYCC). The ownership of the land for which bond release <br />has been requested is federal and private. The coal ownership is private and federal. Federal coal leases <br />C-22644, C-081330, C-05254, C-26914 and C-16284 were mined. Extraction of coal was finished in <br />1988. Reclamation for which bond release has been requested was conducted between 1977 and <br />November of 1991. <br />CYCC has requested Phase II bond release of 2,388.5 acres and Phase III (final) bond release on 224.4 <br />acres known as Area 41. <br />I. PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />Colorado Yampa Coal Company (CYCC) has applied for a partial Phase 11 bond release and a partial <br />Phase III bond release on a portion of the mine under the Colorado Surface Coal Mining and Reclamation <br />Act following reclamation of the Eckman Park Mine and Energy Mine No. 1. The mines are located in <br />Routt County, approximately 23 miles southwest of Steamboat Springs. The mine area is located in <br />portions of Sections 19, 20, and 30, Township 5 North, Range 86 West, and portions of Sections 24, 25, <br />and 36, Township 5 North, Range 87 West, of the 6th P.M. <br />The Eckman Park Mine and Energy Mine No. l are permitted within the CYCC complex of mines under <br />the Eckman Park, Energy Mine No.l and Energy Mine No. 2 permit, Division of Minerals and Geology <br />permit number C-81-071.
