Drainage and sediment control facilities and <br />hydrologic monitoring required under the DMG permit will remain in effect until removal or <br />termination is specifically approved by the Division. <br />4.07.3. Permanent closure measures (including underdrain installation) associated with the <br />main South Mine portal openings and the tan portal adjacent to the access road will need to <br />be specifically addressed, to the extent that they would be altered by the alternative <br />reclamation plan. <br />4.09.1, 4.09.2, and 4.10. To accommodate use of the relatively flat top of the refuse area <br />for material storage under the alternative plan, modifications to the final grading, cover soil <br />and topdressing, and revegetation requirements of the approved plan may be desired. Any <br />such modification of the approved construction and reclamation plan for the Roadside <br />Refuse Disposal Area (RSRDA) associated with the alternative reclamation plan will need to <br />be addressed, and compliance with applicable regulatory criteria will need to be <br />demonstrated. See in particular 4.09.1(1), 4.09.1(5), 4.09.1(7), 4.09.1(81, 4.10.1(1), <br />4.10.3(3), and 4.10.4(5). <br />4.11.4. The requirements of this section will need to be addressed in the revision <br />application, to the extent that non-coal waste disposal under the alternative reclamation <br />plan will differ from the currently approved reclamation plan. <br />4.13. Contemporaneous reclamation will need to be achieved. A schedule and specific <br />timeframes for reclamation activities to be conducted in association with the alternative land <br />use will need to be included in the alternative reclamation plan. The Figure 14-1 <br />reclamation schedule in the approved reclamation plan will need to be amended to allow <br />reasonable time for implementation of the alternative land use. However, the schedule will <br />need to include a specific deadline for initiation and completion of the wildlife habitat <br />reclamation plan in the event that the alternative land use is not implemented in a timely <br />manner. The alternative land use will need to be implemented within 2 years of approval of <br />the permit revision, or within 2 years after regrading is completed, whichever is later (see <br />4.15.10(2)). <br />4.14. The alternative land use reclamation plan will need to include a detailed backfilling <br />and grading plan including appropriate narrative, maps and cross-sections as necessary to <br />demonstrate compliance with 4.14.1(1)(d), 4.14.1(2), 4.14.2, 4.14.3, and 4.14.6. <br />4.15. A plan for revegetation compatible with the alternative post-mining land use plan will <br />need to be included.
