i

Finally, revegetation activities will establish a permanent vegetative cover
of the same seasonal variety native to the area and capable of
self-regeneration and plant succession equal in extent and cover to the
natural vegetation in the area.
The tit. Gunnison No. 1 Mine permit application was originally submitted on
November 6, 1979, and was approved on July 31, 1981. A five year permit was
issued on July 31, 1981 pursuant to the Colorado Surface Coal Mining
Reclamation Act, CRS 34-33-101 et seq. Since that time West Elk Coal Company
has operated the Mt. Gunnison No. T-Ffine in compliance with the terms and
conditions of their permit and the Act and Regulations of the Colorado t4ined
Land Reclamation Board for Coal Mining.
On January 17, 1986, the application for a five year renewal of the permit
application was submitted.
The legal description of lands included within this permit renewal is as
follows:
Sections 9, 10, 15, 16, 17, 18, 19, 20, 21, 22, 26, 27, 28, 29, 30 and
34, T135, R90W of the 6th P.M. in Gunnison County.
The following decision document and findings of compliance was prepared for
the entire Mt. Gunnison permit area permitted to date under permit C-007-80.
Any stipulations from the original permit and findings document or subsequent
revisions that have been totally resolved to the satisfaction of the Division,
have been removed from this document. Therefore this document represents
current findings of compliance, and current stipulations still in affect.
This document also contains current cumulative hydrologic impact assessments
which have been expanded to include all areas of anticipated mining under
current MLRD and OSM regulations.
14
