<br /> <br />November 11, 1994 <br />Pueblo County "~ <br />Department of Planning and Development <br />Pueblo County Courthouse <br />Tenth and Main Streets <br />Pueblo, Colorado 81003-2947 <br />Gentlemen: RE: SUP 570, Revision <br />We are in the process of updating our MLRB mining permit <br />with the Division of Minerals and Geology. As part of our <br />revised permit we will be increasing the area included in <br />our permit which will also increase the area included in. <br />our Special Use Permit with the County. <br />Attached are various maps indicating the areas to be <br />included in our mining permit as well as our plant site <br />area. Since our plant uses aggregates from many sources it <br />is our intention to exclude the plant area from the MLRB <br />permit area. The plant site area is being enlarged <br />somewhat to allow use to expand our operations at the <br />plant. The pit are being permitted will not all be <br />excavated and used as pit area. The vast majority of the <br />area will essentially not be disturbed. We are permitting <br />the entire area in order to reduce the disputes with the <br />MLRB concerning disturbed areas. Their attitude in the <br />past is that if they found vehicle tracks outside the pit <br />boundaries then they considered that associated with mining <br />activities and took the attitude that we were operating <br />outside the pit boundaries. By permitting the entire area <br />we will have some flexibility as to stockpile sites, <br />staging areas, and support facilities. <br />We currently have enough water rights dedicated to <br />evaporation loss of exposed groundwater to augment <br />approximately 33 acres of groundwater surface area. we <br />intend to work the current excavation area to form <br />approximately a twenty (20) acre lake. The new excavation <br />area will be limited to 13 acres until we can gain approval <br />of an augmentation plan that will permit more area, <br />ultimate size of this excavation will also be approximately <br />EXHIBIT <br />-_~~a .. <br />
