No. 570 (2nd Amended) <br />December 12, 1994 <br />Page 2 <br />The applicant shall provide the Department of Planning and Development <br />with a copy of any future local, State, or federal applications, <br />permits, or amendments pertaining to SUP No. 570, within 30 days of <br />their submittal or approval. This includes, but is not limited to, <br />MLRB, 404/401, water well, air quality, NPDES permits, and plans for <br />augmentation. <br />Special Use Permit No. 570 shall be reviewed on a complaint bas`_s only. <br />ZONING AND LAND USE <br />The property and surrounding properties are in an A-1, Agricultural <br />(minimum 40 acres) Zone District. To the north, on the other side of <br />Highway 96 East, the property is zoned I-2, Light Industrial. To the east <br />the area consists of A-2, Agricultural (minimum 5 acres) Zone District, A-4, <br />Agricultural (minimum i acre) Zone District, and a small B-1, Neighborhood <br />Business District area near the intersection of 36th Lane and Highway 96 <br />East (Exhibit 3). <br />The property consists of a batch plant area and a gravel pit area. Tne <br />Colorado Interstate Gas Company is located to the north of the batch plant. <br />The surrounding land use consists of single-family residences and <br />agricultural farmland (Exhibit 3). <br />FIRE PROTECTION <br />The property is located within the service area of the Pueblo Rural Fire <br />District. <br />FLOODPLAIN <br />The batch plant portion of the property does <br />Hazard Area" , but a majority of the sand and <br />FEMA's Flood Insurance Rate Map, Community <br />September 29, 1989. <br />ACCESS <br />not lie within a "Special Flood <br />gravel pit area does, based on <br />Panel No. 080147 0275B, dated <br />The property is accessed from Colorado State Highway 96 East. The applicant <br />has obtained a State Highway Access Permit (No. 50B/324-88/R/GAT). <br />PERMITS <br />• MLRB -The applicant currently has a Mined Land Reclamation <br />112 Regular Permit (No. M85-218). The applicant informed staff <br />that they are in the process of "Amending" their MLRB permit. <br />The amendment to the MLRB permit will include the additional <br />acreage; but will exclude the batch plant area which, according to <br />the applicant, does not need to be covered by the MLRB permit, <br />since the plant receives minerals from many other off-site sources. <br />
