BANTA, Director <br />March 17, 1988 <br />Mr. James Lunan <br />Peabody Coal Company <br />1300 South Yale <br />Flagstaff, AZ 86001 <br />Re: Nucla Mine -Professional Certifications Permit C-81-008 <br />Dear Mr. Lunan: <br />While the following discussion pertains specifically to the Nucla Mine, <br />the concept is applicable to Seneca II and II-W and should, therefore, be <br />also considered for these mines. <br />During a review of the application document for Renewal No. 1„ we found <br />that some of the haul roads at Nucla may not have been certified. <br />Therefore, we requested Peabody to submit road certifications for the <br />haul roads accessing Mine Areas 2 and 3. In your March 10, 1988 letter, <br />you referenced pages 12-16a and 12-16b of the Technical Revision No. 2 <br />application for the as-built certifications. These certifications do not <br />address the requirements of the regulations as addressed in the <br />Professional Certification Policy Memorandum dated July 13, 1984. (This <br />document was originally forwarded to all coal operators shortly after <br />execution and more recently again to Peabody by Ms. Cathy Bege,) in <br />reference to inadequate pond certifications.) <br />The policy memorandum addresses the concerns the Division has about <br />professional certifications and will not be reiterated here.
