<br /> <br />ANY STRUCTURES BUILT IN THE FUTURE WITHIN THE PERMIT AND ADJACENT <br />AREAS THAT COULD BE IMPACTED BY SUBSIDENCE AS A CONSEQUENCE OF <br />THE CURRENTLY PROPOSED MINE PLAN, AND <br />ANY EXISTING STRUCTURES IN THE PERMIT OR ADJACENT AREAS THAT <br />COULD BE IMPACTED BY SUBSIDENCE AS A CONSEQUENCE OF A CHANGE IN <br />MINE PLAN DURING THIS PERMIT TERM. <br />Stipulation No. 71 <br />THE PERMITTEE WILL SUBMIT TO THE DIVISION BY APRIL 21, 1994 A COMPREHENSIVE <br />TECHNICAL REVISION WHICH ADEQUATELY ADDRESSES: <br />1. APPROPRIATE TOPSOIL REPLACEMENT REQUIREMENTS AND AN ADEQUATE <br />TOPSOIL MASS BALANCE ANALYSIS;. <br />Z. MORE APPROPRIATE REVEGETATION SUCCESS STANDARDS, BETTER <br />DEFINED VEGETATION SAMPLING METHODOLOGY, AND MORE <br />APPROPRIATE REVEGETATION SEED MIXES. <br />STATUS OF STIPULATIONS <br />The following is a list of stipulations that are still active: <br />Stipulation No. 28 <br />THE PERMITTEE SHALL PERFORM A SURVEY OF THE FIVE POTENTIALLY AFFECTED <br />ADOBE CONSTRUCTED HOUSES ON A QUARTERLY BASIS, IN COMPLIANCE WITH THE <br />REQUIREMENTS OF RULE 2.05.61611c11i11D1. <br />Stipulation No. 50 <br />THE PERMITTEE WILL PERFORM AN ARCHAEOLOGICAL INVESTIGATION IN AREAS <br />HAVING THE HIGHEST POTENTIAL FOR LOCATING CULTURAL RESOURCES BEFORE <br />PROCEEDING WITH THE MINING OPERATION IN THE AREA ADDRESSED BY THIS PERMIT <br />REVISION. <br />Stipulation No. 51 <br />PRIOR TO SECONDARY OR RETREAT MINING AT THE GOLDEN EAGLE MINE, THE <br />PERMITTEE SHALL PROVIDE A HYDROLOGIC SURVEY OF WET CANYON. THE SURVEY <br />SHALL CONTAIN INFORMATION CONCERNING DEPTH BELOW THE SURFACE, <br />HORIZONTAL EXTENT, WATER USE, AND QUANTITY AND QUALITY OF GROUND WATER <br />AS REQUIRED UNDER RULE 2.04.7111. THE PERMITTEE SHALL ALSO PROVIDE A <br />DISCUSSION OF PROBABLE HYDROLOGIC CONSEQUENCES OF MINING UPON THOSE <br />ALLUVIAL AQUIFERS IDENTIFIED. <br />Stipulation No. 52 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER WET CANYON, THE PERMITTEE <br />MUST COLLECT DATA ON THE QUANTITY OF WATER FLOWING IN THE DRAINAGE. <br />MONITORING MUST BE SUFFICIENT TO DIFFERENTIATE SEASONAL FLOW VARIATIONS. <br />3 <br />
