• DANZELS SAND PIT NO. 2 PERMIT AMENDMENT <br />73-7 <br />EXHIBIT M <br />LOCAL GOVERNMENT APPROVAL <br />Daniels Sand Pit No. 2 has a legal nonconforming use to <br />the entire tract which is subject to this amendment. No special <br />use permit, location approvals or additional local government <br />approvals are needed. Confirmation of these rights was made on <br />January 8, 1981 by the E1 Paso County Board of Adjustment which <br />upheld Transit Mix Concrete Company's position that it needed no <br />additional local government approvals prior to the granting of <br />Transit Mix's conversion application by the Colorado Mined Land <br />Reclamation Board. <br />Further confirmation of the legal right to continue <br />extraction of sand and gravel over the entire area is embodied in <br />the letter of John D. Fisher, Director of the E1 Paso County Land <br />Use Department, dated October 19, 1984, to G. Scott Briggs, <br />Esquire, attorney for Transit Mix Concrete Company, a copy of <br />which was recorded on October 23, 1984 at Reception No. 1174757 <br />in Book 3931 at Page 515-521 in the records of the Clerk and <br />Recorder of E1 Paso County, Colorado. <br /> <br />
