Water Division 7, Water District 71 Dear Mr. Brumley: This letter is in response to your application of September 12, 2001 requesting a substitute water supply plan for a sand and gravel pit to be operated by Four States Aggregate, LLC in accordance with 37-80-120 C.R.S. The Applicant shall be responsible for compliance with this plan, but the State Engineer's Office may also pursue the landowner for eventual compliance. The required fee of $1,343 for the substitute water supply plan has been paid. This plan describes the water uses for the first year of this new mining operation. The consumptive use of the first year is 9.31 acre-feet. A revision of your monthly breakdown of the annual depletions total 1.73 acre-feet of evaporative loss from a maximum of 1.06 acres of exposed groundwater, 1.22 acre-feet of water used for aggregate washing, 3.27 acre-feet of water used and consumed for dust control and 3.09 acre-feet of water lost with the mined product. According to the information submitted, no water surface was exposed within the permit boundary prior to January 1, 1981, The Line Camp Pit is located approximately 250 feet from the Dolores River. Lagged effects to the Dolores River are presented in Table I. The proposed source of replacement water for this pit is the firm yield consumptive use credits from the dry up of historic irrigation on the property that is to be mined. The plan proposes to use 23.49 acre-feet of the historic consumptive use credits from the dry up 21.35 acres of land historically irrigated by the Home Ditch rights that will be taken out of production for this operation. These consumptive use credits will be used to offset the annual depletions created by this operation. The Applicant has entered into a contract with MVIC to store and release replacement water from Groundhog Reservoir for this plan when ditch credits would not otherwise be available to replace depletions to the Dolores River.
