included in the 10.5-acre Parcel 24. This 0.5-acre pazcel was assigned to the Long-term spoil <br />area and was not included in the SL3 acreage requested for Phase II bond release. The acreage <br />requested for bond release is 53.9 acres. <br />The Division received a hydrology demonstration from Savage and Savage Environmental <br />Services on November 22, 2005. The Division reviewed the demonstration and on December 2, <br />2005 forwarded one additional technical question regazding the hydrology demonstration. A <br />recalculated sedimentology demonstration was provided to the Division on December 9, 2005. <br />The recalculated demonstration was found acceptable. <br />Coors Energy Company supplied an updated Appendix L-5 map on November 30, 2005 <br />removing the 0.5-acre azea identified during the October 6, 2005 inspection, from the bond <br />release application. This 0.5-acre area is included in the long-term spoil area. This revised map <br />was found acceptable. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />PHASEI <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released <br />when the pennittee successfully completes backfilling, regrading, and drainage control in <br />accordance with the approved reclamation plan." With regard to Phase I bond release, the <br />approved reclamation plan for the Keenesburg Strip Mine calls for backfilling mine pits to the <br />approximate original contour (permit page 113). All parcels included in SL-03 (1, 3, 8, 14, 18, <br />21, 24, 26, 27, and 28) have previously received Phase I bond release approval. <br />PHASE II <br />Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall be <br />released upon the establishment of vegetation which supports the approved postmining land use <br />and which meets the approved success standazd for cover... based on statistically valid data <br />collected during a single year of the liability period". hi regazd to Phase II bond release, Rule <br />3.03.2(3)(b) also states, " No more than sixty (60) percent of the bond shall be released so long <br />as the lands to which the release would be applicable are contributing suspended solids to <br />streamflow or runoff outside the permit area in excess of premising levels as determined by <br />baseline data or in excess of levels determined on adjacent nonmined azeas". <br />With regard to Phase II bond release, the approved reclamation plan is found in Section 2.05.4 of <br />the permit application. The available topsoil is wind-deposited sandy topsoil The required <br />topsoil replacement thickness is two (2) feet. The approved seed mix is found on permit page <br />115. Vegetative cover is compazed to the Osgood Sand Reference Area. Vegetative cover is <br />considered successful when the total vegetative cover is equal to or greater than ninety percent <br />(90%) of the total vegetative cover measured on the Osgood Sand Reference Area. The <br />approved post-mining land use is rangeland. The Dugout Pond, perimeter ditches, and Pond 2 <br />have been approved to remain as permanent structures. <br />C-1981-028, SL-3 4 4/18/2006 <br />
